Terms and Conditions

Scope

These General Terms and Conditions (GTC) govern the contractual relationship between Alberti’s Classic Motorcycles – Werkfunke workshop and its customers for all services, repairs, restorations, and modifications of motorcycles as well as for the sale of spare parts and accessories.

Conclusion of Contract

A contract is concluded through written or verbal acceptance of an estimate or by delivering a vehicle for repair or maintenance. Additions and changes are only valid if confirmed in writing by both parties.

Scope of Services

The workshop undertakes to perform the commissioned work professionally according to recognized technical standards. The exact scope of services is defined by the issued order.

Prices and Payment Terms

All prices are in Swiss Francs (CHF) including VAT, unless stated otherwise.
Payments are generally due upon vehicle collection unless agreed otherwise. In case of late payment, the workshop is entitled to charge 5% p.a. interest and reminder fees.
Invoices must be paid, unless otherwise agreed, within 10 days net.
Additional or reduced costs up to 15% according to the estimate or agreement will be carried out without further consultation; any further cost changes will be discussed immediately.

Estimates

Estimates are non-binding unless expressly stated as binding in writing. If additional defects are found during the repair, the customer will be informed and their consent obtained to continue.

Acceptance and Handover

The customer undertakes to collect the vehicle within five working days after notification of completion. If not collected, the workshop may charge storage fees.
Upon delivery of the vehicle, the service is considered accepted unless an immediate written complaint is made.

Warranty and Liability

The workshop is liable for the professional execution of the work under the statutory warranty obligations (Art. 367 ff. Swiss Code of Obligations). The warranty expires if the customer or third parties make changes without the workshop’s consent. No liability is assumed for damage caused by improper use, natural wear, or force majeure. Liability for slight negligence is excluded to the extent permitted by law.

Spare Parts and Old Parts

Installed parts become the property of the customer. Old parts are disposed of unless the customer expressly requests their return.

Retention of Title

Installed parts and accessories remain the property of the workshop until full payment is made.

Right of Retention

The workshop is entitled to retain the vehicle until full payment of the services provided (contractor’s lien).

Data Protection

Personal data is processed solely for the purpose of fulfilling the order and is not shared with third parties unless legally required. See also: Privacy Policy

Jurisdiction and Applicable Law

For all disputes, Swiss law applies, excluding international conventions.
The competent court is the Regional Court Berner Jura-Seeland, unless mandatory legal provisions state otherwise.

Severability Clause

Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions remains unaffected. A replacement provision that closely aligns with the economic purpose of the original clause will apply.
